Colorado uses a distinctive public trustee foreclosure system โ one of the few states where a government-appointed public trustee (not a private trustee or lender’s attorney) conducts the sale. With 10,400+ active listings and markets ranging from the Denver metro to Colorado Springs, Fort Collins, and mountain resort communities, Colorado offers foreclosure buying opportunities in a state with strong long-term appreciation fundamentals.
Colorado’s foreclosure process is governed by C.R.S. ยง 38-38-101 et seq. and uses a public trustee โ a county official โ to conduct non-judicial foreclosures. Every county has a Public Trustee’s Office. The process requires a Rule 120 court proceeding (a brief, limited court review) before the sale can proceed, giving it a quasi-judicial character. Timeline: approximately 4 to 6 months from default to sale.
Notice of Election and Demand (NED): The lender files a NED with the county Public Trustee, triggering the process. The NED is recorded with the county clerk and recorder โ this is the public pre-foreclosure signal.
Rule 120 proceeding: The lender files a Rule 120 motion in district court requesting authorization to proceed with the sale. The borrower can contest. In uncontested cases, Rule 120 approval takes 30-45 days and is routine.
Combined Notice: Once Rule 120 is approved, the Public Trustee publishes a Combined Notice of Sale in a local newspaper for 5 consecutive weeks.
Public Trustee Sale: Conducted by the county Public Trustee โ a public official, not a private party. Sales are typically held at the county courthouse or Public Trustee’s office. The Jefferson County, Arapahoe County, and Denver County public trustees conduct high-volume sales; others are smaller.
Payment: The full bid amount is due at the sale in certified funds (cashier’s check or cash). No deposit-then-balance structure โ full payment on the day.
Right of redemption: Colorado provides a 75-day redemption period after the sale during which the prior owner or junior lien holders can redeem. The property is subject to redemption rights for 75 days โ plan accordingly before making renovation or rental plans.
Public Trustee’s Certificate of Purchase: Issued at the sale. After the 75-day redemption period expires without redemption, the Public Trustee issues a Confirmation Deed conveying clear title.
Denver County โ Urban Denver. High prices, thinner foreclosure inventory relative to population. Tech and energy economy.
Jefferson County (Lakewood, Arvada, Wheat Ridge) โ West Denver suburbs. Active Public Trustee sale volume. Strong housing demand.
Arapahoe County (Aurora, Centennial, Englewood) โ South Denver suburbs. High foreclosure volume. Aurora has significant foreclosure inventory across diverse neighborhoods.
El Paso County (Colorado Springs) โ Military market (Fort Carson, Peterson SFB, Schriever SFB, NORAD/NORTHCOM). High foreclosure volume from PCS-driven defaults. Strong rental demand.

Larimer County (Fort Collins) and Weld County (Greeley) โ Northern Front Range. College town and agricultural markets. Active Public Trustee sales.
Title search through the county clerk and recorder before every bid. Confirm Rule 120 approval before bidding โ if contested, the timeline may shift. Check property tax status with the county treasurer. Plan for the 75-day redemption period before taking possession. Colorado’s mountain and Front Range geography creates flooding, wildfire, and HOA complexity โ research all applicable risks for each specific property location.
Public Trustee sale: Full payment at sale in certified funds. Hard money must be pre-arranged. Pre-foreclosure/REO: Conventional, FHA, VA, USDA. Colorado Housing Finance Authority (CHFA) offers mortgage programs and down payment assistance.
