How Delaware Foreclosure Works

The lender files a complaint in the Superior Court, serves the borrower, and after court proceedings the county sheriff conducts the sale. Timeline: approximately 6 to 12 months. The sale is advertised for 4 consecutive weeks in a local newspaper.

Delaware operates a mandatory Foreclosure Mediation Program for owner-occupied residential properties โ€” eligible borrowers can request mediation, which adds time but keeps properties in pre-foreclosure status longer. No post-sale right of redemption after a Delaware foreclosure sale โ€” once confirmed by the court, the sale is final.
