State Foreclosure Guides

Idaho Foreclosure Listings & Complete Buying Guide

Idaho is primarily a non-judicial foreclosure state โ€” trustee sales complete in approximately 5 to 6 months from Notice of Default. No post-sale right of redemption for non-judicial sales. With rapidly growing markets in Ada County (Boise), Canyon County (Nampa/Caldwell), and Kootenai County (Coeur d’Alene), Idaho offers foreclosure inventory in one of the fastest-appreciating real estate markets in the country โ€” though strong demand has thinned active inventory significantly since the pandemic-era price surge.

How Idaho Foreclosure Works

Idaho uses non-judicial deed of trust foreclosure under Idaho Code ยง 45-1505. The trustee records a Notice of Default with the county recorder and mails copies to the borrower and any junior lien holders. After a 115-day waiting period from the NOD recording, the trustee can record a Notice of Trustee’s Sale. The NTS must be published weekly in a local newspaper for 4 consecutive weeks before the sale date. Total minimum timeline from NOD to sale: approximately 150 days.

Trustee’s Sale: Held at the county courthouse or another publicly designated location specified in the NTS. Full cash payment required at the sale in certified funds. No post-sale right of redemption for Idaho non-judicial trustee sales.

Judicial foreclosure is available in Idaho but uncommon โ€” used for tax liens and situations where the security instrument lacks a power-of-sale clause. Idaho judicial foreclosures carry a 12-month right of redemption โ€” a significant difference from non-judicial sales.

Major Markets

Ada County (Boise) โ€” State capital and largest market. Tech economy (Micron, HP, Clearwater Paper) and growing remote worker influx. Boise was one of the hottest real estate markets in the country 2020-2022; subsequent rate increases created a wave of pre-foreclosure activity in 2024-2026. Active foreclosure pipeline across Boise, Meridian, Eagle, and Kuna. Canyon County (Nampa, Caldwell) โ€” More affordable Ada County neighbor. Active foreclosure inventory as pandemic-era buyers face affordability stress. Manufacturing and agriculture economy. Kootenai County (Coeur d’Alene, Post Falls) โ€” Northern Idaho’s largest market. Remote worker and retiree destination. Active pre-foreclosure pipeline driven by high pandemic-era purchase prices. Twin Falls County โ€” Central Idaho regional hub. Agriculture and manufacturing economy. Affordable prices, consistent foreclosure inventory.

Due Diligence

Title search through the county recorder before every bid. Senior liens survive the trustee sale. Confirm whether the sale is judicial or non-judicial โ€” the 12-month redemption period applies only to judicial sales. Tax status: check with the county assessor/treasurer. Idaho property taxes are assessed and paid annually. Water rights: for any rural Idaho property, confirm water rights โ€” Idaho’s prior appropriation water law means water rights are separate from surface ownership and must be specifically conveyed. Confirm sale is proceeding the morning of the auction โ€” Idaho trustee sales are frequently postponed.

Financing

Trustee sale: Full cash at sale in certified funds. Hard money pre-arranged. Pre-foreclosure/REO: Conventional, FHA, VA, USDA widely available. Idaho Housing and Finance Association (IHFA) offers First Loan programs with down payment assistance. USDA available in qualifying rural Idaho areas.
