State Foreclosure Guides

South Carolina Foreclosure Listings & Complete Buying Guide

South Carolina is a judicial foreclosure state with a distinctive auction process โ€” sales are conducted by a court-appointed Master-in-Equity rather than a county sheriff, held on the first Monday of each month at the county courthouse. With 15,700+ active listings statewide and strong markets across the Grand Strand, Charleston metro, and upstate Greenville-Spartanburg, South Carolina offers consistent foreclosure inventory in a state with rapid population growth and rising home values.

How South Carolina Foreclosure Works

South Carolina is exclusively judicial. The lender files a complaint in the Circuit Court, the borrower is served, and after judgment the case is referred to a Master-in-Equity โ€” a court official specific to South Carolina who handles complex civil cases including foreclosures. The Master orders and oversees the sale. Timeline: typically 6 to 12 months from complaint to auction.

The Master-in-Equity Sale

South Carolina foreclosure auctions are conducted by the county Master-in-Equity (or by the Clerk of Court in smaller counties without a Master). Sales are held on the first Monday of each month at the county courthouse, between 11:00 AM and 5:00 PM.

Advertisement: The property must be advertised in the county’s official legal newspaper for three consecutive weeks before the sale, and posted at the courthouse and two other public locations.

Deposit: Typically 5% of the bid price in certified funds immediately at the sale.

Balance due: Within 20 to 30 days of the sale โ€” confirm with the specific county Master.

Redemption period: South Carolina provides a 30-day upset bid period after the sale โ€” a unique feature where any person can submit an upset bid of at least 5% more than the winning bid during the 30 days following the sale. If an upset bid is submitted, the original winning bidder gets their deposit back and the process restarts. The upset bid period continues until 30 days pass with no new upset bid. This means your winning bid isn’t final for at least 30 days โ€” plan accordingly.

Deed: After the upset bid period closes without challenge, the Master issues a Master’s Deed conveying the property.

South Carolina’s Major Markets

Horry County (Myrtle Beach / Grand Strand) โ€” One of the state’s highest foreclosure volume counties. Tourism and retirement economy. Mix of beach condos, vacation homes, and primary residences. Condo HOA complexities require careful assessment research.

Charleston County โ€” High-value coastal market. Strong demand from military (Joint Base Charleston), tech, and professional services. Foreclosure inventory is thinner but prices are higher when distressed properties do appear.

Greenville County โ€” Upstate’s largest market. BMW manufacturing and Michelin drive strong employment and housing demand. Active foreclosure market at diverse price points.

Richland County (Columbia) โ€” State capital and University of South Carolina. Government, military (Fort Jackson), and healthcare employment. Consistent foreclosure inventory.

Spartanburg County โ€” Manufacturing economy. More affordable than Greenville. Active pre-foreclosure pipeline with good investor opportunities.

Florence and Sumter Counties โ€” Lower price points, active foreclosure markets, less auction competition.

Due Diligence Checklist

Title search: Run a full title search through the county Register of Deeds before every bid. The Master’s Deed conveys without warranty.

Upset bid period: Never make firm plans for the first 30 days after winning โ€” you could be outbid. Have contingency plans if your bid is upset.

Tax status: Check with the county treasurer for delinquent property taxes โ€” a senior lien that survives foreclosure.

HOA assessments: South Carolina HOAs can have priority liens for assessments. Get estoppel letters on any HOA or condo property.

Flood zones: Coastal and low-country South Carolina has significant flood risk. Check FEMA flood maps before bidding on any coastal or tidal area property. Charleston and Horry counties have extensive flood zone designations.

Occupied properties: South Carolina eviction (ejectment) after foreclosure typically takes 4-8 weeks.

Financing

Auction: 5% deposit immediately, balance within 20-30 days. Cash or hard money. Note: the upset bid period means you won’t have clear title for at least 30 days after winning.

Pre-foreclosure and REO: Conventional, FHA, VA, USDA. SC Housing offers down payment assistance. USDA financing available in many rural SC areas.
